Well I still can't make changes with alsamixer, even after adding 'dtparam=audio=on'... not important really, so don't care... unless it becomes important, to me.

Has anyone else had issues with getting their dac hats working after this last update?
my pi still won't initialize the hat. broke the moment i upgraded the kernel

Yes.
Frank's instructions are spot on.
Make sure to resize your SD Card partition.

Thank you, gentelmens! This real working. Raspberry Pi3 / Audiophonics Es9023 TXCO V3. An hour listening channels have not changed

but! right and left channels are reversed. There is a possibility to change them?
(so far just changed the wires, but it is eating me)

I have same issue. I just realized I have channels swapped.
I have spent few hours last night trying to figure out whats wrong. Whats worst this occurs on other OS. I have tried MoodeAudio, Volumio and is still same
I have RPi2+Audiophonics I-Sabre EC9023 DAC

I have tried kernel update to latest version Linux runeaudio 4.4.14-2-ARCH but is still same

In my case issue resolved. Kind of It is down to the DAC itself where they messed up when they manufactured PCB
